Macko's Views on Justice

                                      JUSTICE

"The jury has a right to judge both the law as well as the fact in controversy."   John Jay, the first Chief Justice of the U.S. Supreme Court  1789

"The jury has the right to judge both the law as well as the fact in controversy."  Samuel Chase, U.S. Supreme Court Justice 1796

"The jury has the power to bring a verdict in the teeth of both law and fact."  Oliver Wendell Holmes, U.S. Supreme Court Justice 1902

"The law itself is on trial quite as much as the cause which is being decided."  Harlon F. Stone, 12th Chief Justice, U.S. Supreme Court  1941

"The pages of history shine on instances of the jury's exercise of its prerogative to disregard instructions of the judge..."

U.S. vs. Dougherty  473 F 2nd 1113, 1139  1972

Jury rights or jury nullification, as it is sometimes called, helped establish freedom of religion and end slavery and alcohol prohibition.

Macko will vote to require all federal judges to read the above mentioned statements to all jurors. In any case where this is not done, the defendant will automatically go free.

Macko supports honest investigation of the events of 9-11, including the Project For A New American Century report which stated that a "new Pearl Harbor" would assist the Bush administration to promote its agenda. (See COMMENTARY on 9-11.) We also need honest investigations of the Oklahoma City bombing, the Waco massacre and the Tonkin Gulf incident, which was used to embroil us in the Vietnam war.

Macko will vote to abolish the Department of Homeland Security and the thuggish Transportation Security Administration.

MACKO RECOGNIZES THAT LIFE BEGINS AT CONCEPTION AND ENDS AT NATURAL DEATH. He affirms that abortion is murder. He will support legislation to remove the Supreme Court's appellate jurisdiction over abortion cases thus nullifying the Roe vs. Wade decision which has caused the deaths of over 40,000,000 preborn Americans.

He supports Congressman Ron Paul's Sanctity of Life Act  http://en.wikipedia.or...ity_of_life_act.

Christians, Bible believing Jews and devout Moslems support the right to life. The nontheistic arguments are magnificently presented at www.l4l.org by Doris Gordon, founder of Libertarians for Life.

Macko will vote to outlaw hackable and unverifiable voting machines and to require paper ballots, manually counted with results posted at each precinct in all federal elections.

Macko supports rational, nondiscriminatory ballot access laws and instant runoff voting in all federal elections. He favors abolition of the unconstitutional Federal Election Commission, the McCain Feingold Act and all other federal election laws which discriminate against alternate parties and independent candidates.

Macko will work to allow the American people to decide if they want to ratify the Fourteenth Amendment legally this time. See THE PHONY FOURTEENTH AMENDMENT in the COMMENTARY section.

Macko will vote to repeal all federal laws which discriminate against homosexuals, except where it would compromise our national defense. He will strive to repeal all federal taxes which they regard as unjust. While marriage has always been regarded as a relationship between men and women, voluntary contracts should be upheld by the states and homosexuals should have the same right to contract as everyone else.

Macko opposes any federal marriage amendment or law governing marriage.

According to the Tenth Amendment, adoption laws are under the jurisdiction of the states.

Macko supports the “Read the Bills Act (RTBA).” RTBA requires that . . .

  • Each bill, and every amendment, must be read in its entirety before a quorum in both the House and Senate.
  • Every member of the House and Senate must sign a sworn affidavit, under penalty of perjury, that he or she has attentively either personally read, or heard read, the complete bill to be voted on.
  • Every old law coming up for renewal under the sunset provisions must also be read according to the same rules that apply to new bills.
  • Every bill to be voted on must be
  • published on the Internet at least 7 days before a vote, and Congress must give public notice of the date when a vote will be held on that bill.
  • Passage of a bill that does not abide by these provisions will render the measure null and void, and establish grounds for the law to be challenged in court.
  • Congress cannot waive these requirements.

Macko supports instant runoff voting. This progressive measure would give voters more choices and end all of the phony arguments about "throwing away your votes".  It would benefit all alternate parties and the American people by avoiding separate runoff elections and ensure that all winners have a majority vote.
